Twinsociety Terms and Conditions

Twinsociety is a social networking website that allows multiples to create online profiles in order to find and communicate among each other. Your use of Twinsociety’s social networking website is subject to the terms of a legal agreement between you and Twinsociety. By using TwinSociety.com you agree to all terms and conditions set forth that govern all of its members and site users.

Twinsociety may modify this agreement and such modification shall be effective upon posting on the Twinsociety Website. You agree to be bound to any changes to this agreement when you use the website after such time the modification is posted. We reserve the right to change and modify these usage rules as appropriate and without notice.

Twinsociety assumes no responsibility or liability for information provided to members.

Twinsociety reserves the right, in its sole discretion, to reject, refuse to post or remove any posting (including private messages) by you, or to restrict, suspend, or terminate your access to all or any part of Twinsociety at any time, for any or no reason, with or without prior notice, and without liability.

Profile Picture Policy

Twin Society requires that all profiles must contain a profile picture.

The profile picture must:

* Be a clear headshot, close up, medium close up or full body picture of you and your twin, triplets or any multiples.

* Contain a recent photo of both you and your sibling(s). Individual photos can always be shared within your photo albums.

* Must be a high resolution image of at least 640 pixels.

* May not contain nudity or obscenity.

Accepting the Terms

In order to use the Services, you must first agree to the Terms. You may not use the Services if you do not accept the Terms. You also agreed to this contract between you, “the user”, and TwinSociety.com when you clicked the "I agree" box during signup and perpetually when using the website. You understand and agree that Twinsociety will treat your use of the website as acceptance of the Terms from that point onwards.

By using Twinsociety.com, you represent and warrant that all registration information you submit is truthful and accurate and that you will maintain the accuracy of such information. In addition, you are 14 years of age or older and your use of Twinsociety.com does not violate any applicable laws or regulations. Violation of these Terms and Conditions will cause your membership to be terminated.

If you are 13 years or younger, you must have a parent, or a legal guardian enter and approve all information, and ensure that the parent or legal guardian's email address and contact information is used at all times. Your profile may be deleted and your Membership may be terminated without warning if we believe that you are 13 years or younger.

Use of the Website and Content

In order to create a Membership, you are required to provide information about yourself (such as identification or contact details) as part of the registration process, or as part of your continued use of the website. You agree that any information you give to Twinsociety will always be accurate, correct and up to date.

You agree to use the website only for its intended purposes that are permitted by the Terms and by any applicable laws or regulations.

You agree not to access the website other than through the interface that is provided by Twinsociety, unless you have been specifically allowed to do so in a written agreement with Twinsociety. By using and accessing TwinSociety.com, you agree to abide by international copyright law protecting all images, graphical and written content on the site. You agree that you will not reproduce, duplicate, copy, sell, trade or resell the website’s content for any purpose.

You are solely responsible for maintaining the confidentiality of your password. You agree not to use the account, username, or password of another Member or disclose your password to any third party. You agree to notify Twinsociety immediately if you suspect any unauthorized use of your account. You alone are solely responsible for all activities occurring under your account.

Twinsociety is for the personal use of Members only and may not be used in for any commercial endeavors except those that are specifically approved in writing by Twinsociety. Illegal and/or unauthorized use of the Twinsociety website, including collecting Member’s usernames or email addresses by any means for any purpose is forbidden. Commercial advertisements and any other form of solicitation may be removed and may cause your membership to be terminated. Legal action may be taken for any illegal or unauthorized use of the Twinsociety website.

You should be aware that content including but not limited to advertisements may be protected by intellectual property rights which are owned by the sponsors or advertisers who provide that content to Twinsociety. You may not alter, rent, lease, loan, sell, distribute or produce works originating from this content.

You understand that by using the website, you may be exposed to content that you may find objectionable and that, for this reason, you use the website at your own risk. Twinsociety reserves the right at its discretion to monitor or remove any content from its site. You agree that you are entirely responsible for the profile which you create and for any unexpected consequences.

Twinsociety may delete any content that it may believe violates this agreement or may be offensive, harmful, threatening, illegal or violate any rights. Twinsociety assumes no responsibility for monitoring the website for inappropriate content or conduct. If Twinsociety chooses, in its sole discretion, to monitor the website, Twinsociety assumes no responsibility or obligation to modify or remove any inappropriate content or for the conduct of its members.

You are solely responsible for the content that you post on Twinsociety and any material that you transmit to other members. Twinsociety makes no warranties, express or implied, as to the content or to the accuracy and reliability of the content or any material or information that you transmit to other members. In addition, Twinsociety reserves the right to investigate and take appropriate legal action against anyone who, in Twinsociety's sole discretion, violates any rights or laws, including without limitation, reporting you to law enforcement authorities.

Proprietary Rights in Content on Twinsociety

Twinsociety does not claim ownership of any content that you post to the Twinsociety website. After posting your content to Twinsociety, you continue to retain all ownership rights in such content, and you continue to have the right to use your content in any way you choose. By displaying or publishing ("posting") any content on or through Twinsociety, you hereby grant to Twinsociety a limited license to use, modify, publicly perform, publicly display, reproduce, and distribute such content solely on and through Twinsociety.

You represent and warrant that you own the content posted by you on Twinsociety and the posting of your content on Twinsociety does not violate any other rights of any person. You agree to pay for all royalties, fees, and any other monies owing any person by reason of any content posted by you on Twinsociety.

Twinsociety’s content is protected by copyright, trademark, patent, trade secret and other laws, and Twinsociety owns and retains all rights in the Twinsociety content. Twinsociety hereby grants you a limited, revocable, nonsublicensable license to reproduce and display the Twinsociety content (excluding any software code) solely for your personal use in connection with viewing the Twinsociety website.

Twinsociety contains content of members and other Twinsociety licensors. Except for content posted by you, you may not copy, modify, translate, publish, broadcast, transmit, distribute, perform, display, or sell any content appearing on Twinsociety.

Disclaimers

Twinsociety is not responsible for the content, accuracy or opinions expressed on linked websites, and such websites are in no way monitored by Twinsociety. Inclusion of any linked website on Twinsociety does not imply approval or endorsement of the linked website. When you access third-party sites, you do so at your own risk. Twinsociety takes no responsibility for third party advertisements, products or services which are posted on its website. Twinsociety is not responsible for the conduct, whether online or offline, of any user of Twinsociety.

Twinsociety is not responsible for any problems or technical malfunction of any hardware or software including any injury or damage to users or to any person's computer. Under no circumstances shall Twinsociety be responsible for any loss or damage, including personal injury or death, resulting from use of the Twinsociety website, attendance at a Twinsociety event, from any content posted on Twinsociety, or from the conduct of any members of Twinsociety, whether online or offline.

Limitation on Liability

IN NO EVENT SHALL TWINSOCIETY BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF TWINSOCIETY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, TWINSOCIETY'S LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO TWINSOCIETY FOR THE TWINSOCIETY SERVICES DURING THE TERM OF MEMBERSHIP.

The Terms, and your relationship with Twinsociety under the Terms, shall be governed by the laws of the State of Florida without regard to its conflict of laws provisions. You and Twinsociety agree to submit to the exclusive jurisdiction of the courts located within the county of Dade, Florida to resolve any legal matter arising from the Terms. Notwithstanding this, you agree that Twinsociety shall still be allowed to apply for injunctive remedies (or an equivalent type of urgent legal relief) in any jurisdiction.

Indemnity

You agree to indemnify and hold Twinsociety, its subsidiaries, and affiliates, and their respective officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of Twinsociety in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth above and/or if any content that you post on the website causes Twinsociety to be liable to another.
